TERMS OF USE- CARNOW365 PLATFORM

GENERAL PROVISIONS

These Terms of Use (“Terms”) govern your rights and obligations regarding the use of the CarNow365.com platform and related digital services (hereinafter: the “Platform”), operated by CARNOW365 Ltd. (hereinafter: the “Company”), with its registered office in the European Union, and/or other affiliated companies depending on your country of access.

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of the Terms, you must refrain from using the Platform.

The Platform operates in accordance with the laws of the European Union, including but not limited to the General Data Protection Regulation (GDPR), the E-Commerce Directive, the Consumer Rights Directive, and other relevant national and international regulations.

The Company is committed to protecting users’ personal data and intellectual property, conducting all operations in accordance with industry standards, good business practices, and applicable legal requirements.

The Platform does not constitute professional consultancy, mediation, or any other service except as expressly described herein. The Company does not interfere with nor guarantee the accuracy or utility of user-generated or third-party aggregated content; users are solely responsible for the content they provide or publish.

The Company reserves the right (but not the obligation) to remove any content that violates applicable law or these Terms, at any time, without prior or subsequent notification.

PLATFORM SCOPE AND DESCRIPTION

CarNow365 is designed for advertising, searching, and buying or selling new and used vehicles of all types (passenger cars, motorcycles, commercial vehicles, agricultural machines, boats, bikes, and parts/accessories). The Platform also provides information, guides, and tools relevant to the automotive industry.

Users can post and manage ads, browse offers, compare vehicles, save favorites, and find trusted automotive services in multiple countries and languages.

Any use of the Platform or its parts that is inconsistent with these Terms shall be considered abuse and may result in restrictions or suspension of access.

The Company does not initiate, alter, or select recipients of electronic messages transmitted via the Platform. Access to aggregated content and user-generated content is free of charge. Advertising via the Platform is compliant with EU advertising regulations.

The Company reserves the right to change, temporarily or permanently discontinue any part of the Platform or its services, at any time, without notice.

INTELLECTUAL PROPERTY AND COPYRIGHT

All elements of the Platform—texts, images, databases, software code, design, and more—are intellectual property of the Company, except where rights belong to third parties or users.

Any unauthorized use of any part of the Platform, without express written consent from the Company, is considered a violation of intellectual property rights and subject to legal action.

Users who post content guarantee that they possess all necessary rights and bear full responsibility for their content. By submitting content, users grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content for promotional or educational purposes, subject to proper attribution.

USER CATEGORIES

Visitors are individuals who access the Platform without registration and may freely browse public content.
Registered Users are individuals or legal entities who have registered an account. Personal data is collected, processed, and stored in accordance with GDPR and our Privacy Policy.

Registration does not constitute registration as a business entity under national laws, nor does the Company guarantee the status of registered users as traders.

Users are responsible for maintaining the security of their access credentials, and the Company is not liable for misuse by third parties.

Registered users retain copyright on their own content, warranting that they possess all necessary rights and allowing the Company to use such content for promotional and educational purposes.

ADVERTISING AND AD CONTENT

Advertising is provided exclusively online. Users are solely responsible for the accuracy, legality, and validity of the information and advertisements they submit. The Company may refuse or remove ads that violate law or these Terms.

The Company does not act as an intermediary in the transfer of vehicle ownership or in concluding contracts between users.

MEDIA & VIDEO CONTENT

Users may upload videos and multimedia content as part of their ads. By doing so, users represent that they have all necessary rights to the content (including music and images). The Company reserves the right to remove or disable content upon notification of copyright infringement and may cooperate with relevant authorities.

POSTING AND MANAGING ADS

Ads are posted via a dedicated form. Users are responsible for the accuracy and completeness of all submitted data. If the user has outstanding obligations, the right to publish ads is obtained only after settlement.

For certain vehicle categories, documentation may be required to prove ownership or registration, in line with Platform policies.

The Company reserves the right to limit the number of free ads or change pricing and promotional rules at any time.

RATINGS, REVIEWS, AND FEEDBACK

Users may submit ratings, reviews, and comments, in accordance with the Platform’s rules. The Company reserves the right to remove content that is false, offensive, or otherwise contrary to these Terms or applicable law.

PAYMENTS, REFUNDS, AND CURRENCY CONVERSION

Certain services may be subject to charges according to the current Price List. Payments can be made by credit card or via in-app purchase systems (Apple Pay, Google Pay). Refunds are processed in accordance with the rules of card issuers and EU consumer protection laws.

The primary payment currency is Euro (EUR), but transactions may be converted according to the applicable exchange rate. The Company is not responsible for minor discrepancies due to currency conversion by card associations or payment processors.

DATA PRIVACY & GDPR

The Company is committed to ensuring the privacy and protection of all user data, in compliance with the General Data Protection Regulation (GDPR). Only essential data required for service provision and communication is collected and securely stored. All user data is accessible only to authorized employees and partners.

Users have the right to request access, correction, or deletion of their personal data, and to withdraw consent at any time.

SECURITY OF TRANSACTIONS

All credit card information is transmitted securely using SSL encryption. The Company never stores full card details on its servers. Payment processing is handled by licensed third-party providers.

NOTIFICATIONS

The Company may occasionally send service-related notices, updates, and promotional information via email, SMS, push notifications, or similar means, in accordance with user preferences and applicable law.

USER GUIDELINES & ACCEPTABLE USE

Users must comply with all rules for posting, content, and interactions, and may not publish or distribute any illegal, offensive, misleading, or infringing material. Prohibited conduct includes (but is not limited to): posting false information, spamming, impersonation, copyright infringement, harassment, exploitation, or any activity violating Platform integrity or the law.

The Company reserves the right to remove content and suspend or terminate user accounts for violations.

LIMITATION OF LIABILITY

Use of the Platform is at the user’s own risk. The Company is not liable for the conduct of other users, any damages, loss of data, interruptions, or technical issues, except in cases of intent or gross negligence by the Company.

DISPUTE RESOLUTION AND JURISDICTION

For all matters not expressly governed by these Terms, the laws of the European Union and/or the relevant member state apply. Parties will seek to resolve disputes amicably; otherwise, the competent court in the country of the Company’s registered office shall have exclusive jurisdiction.

MODIFICATIONS AND VALIDITY

The Company reserves the right to amend these Terms at any time, with notification to users at least 8 days prior to entry into force. Continued use of the Platform after changes constitutes acceptance of the new Terms.

APPLE & GOOGLE PAYMENTS — IN-APP PURCHASES

Purchases made via iOS or Android apps (Apple Pay, Google Pay) are governed by the rules of the respective platform:

Subscriptions: Renew automatically unless canceled by the user before the renewal date.
Credit Packs: One-time purchase, do not renew automatically.
All features are available immediately upon confirmation of payment.
Invoices will be issued after funds are received from Apple/Google.
